Planning Permission for Keeping a number of dogs (REFUSED)

Before I continue.... I would like to thank deeply the following in their efforts and contributions in our planning application from residential, to mixed change of use (residential/keeping of a number of dogs)....

Malcolm Goodwin... my friend and considered brother
Mark Allaway... our vet
Jennifer Baxter... Senior Enforcement Officer of the Lewes District Council
Steve Howe... Case Officer of the Lewes District Council
And, to those that deemed/considered that this application should be approved!

On Wednesday the 16th September, around 6.30PM, our retrospective planning permission was refused for the keeping of a number of dogs; based on 2mins max of noise pollution five days a week while the dogs were being loaded up into the van for training, the potential of noise (not fact), area unsuitability. And strangely enough, the movement of dog food bowls while dogs where being feed!
In the chamber, the local parish/councillors, moved into the above motion to refuse approval of the retrospective planning permission on these basis, and in my opinion, the following can rot/burn in hell with the rest of the neighbours that pushed for this motion.... and deserve no less... for their future.... just mixed bureaucratic politics with no regards to the implications or concerns of life, other then human!

Despite all the effects from those previously mentioned, in all honesty; the motion was passed prior to the chamber. It amazes us; that the movement of dog bowls contributes towards more nuisance noise to that of neighbouring dogs/lawn mowers etc.... canny or what to say the least and ironic! From now on.... I will remark on any other dog/child noise I hear and forward that to the appropriate committee/department. As our lives have been turned upside down and inside out!!! One thing is sure in life; being nice gets you nowhere, that is for certain. At the end of the day, it does not matter if our dogs emit noise or not; it purely comes down to owning a number of dogs!!!
Back in the winter of 05/06; we had onsite 14 dogs.... because the neighbours did not know of their existence.... nothing was mentioned. In fact, most neighbours thought we only had three dogs! With this in mind; what can you say.... except that when they knew the existence of a number of dogs, it becomes an issue.... I leave that conclusion to you, the reader! The fact still remains; that many people do not understand the dogs needs, and probably their own, if the truth was known... and people only see what they want to see! (thank you Magali) And have mixed feeling in what they are! or what there needs are! The agonising decisions we are left with; is uncertain at the moment... but will keep this updated with current events until the end!

Don't know what to say guys - such bad news.

I was quite hopeful as the council were recommending approval, but didn't allow for the spineless councillors who just want peoples votes.

You must appeal though.

Please don't give up on your dream! You've clearly worked very hard (both for the dogs and to appease your neighbours) it would be awful to have to let it all go. There must be a solution...

You've probably thought of these already but just in case you haven't had a chance to think about alternatives yet:

If you can only keep 6 at one time how about finding an interested party locally who would become part of the Winterpaws team and could house half the pack while you keep the other half?
As they are kept in separate enclosures at the moment, surely it would be possible to have them in separate locations and then pick them up when you take them for their run? Dogs are very adaptable and wolf packs often separate and then re-join so it should be possible - maybe there is some information on this out there and a person who has knowledge of huskies and sled dogs who would love to be involved in a successful racing team like Winterpaws?

Alternatively, property prices are high at the moment but what about buying some land fairly locally and living in a mobile home (some of them are quite luxurious) and then setting up your kennels on the land? I'm not quite sure how planning laws work but i once knew someone who bought some land and lived on it for 10 years in a caravan and after that they were automatically allowed to build a proper home. This option while quite dramatic and risky might be worth researching as it would give your hobby space to grow...

Whilst there can be no doubt regarding the level of dedication to your hobby, I am amazed such a large number of dogs are being kept in such a confined area. Your garden is tiny,therefore surely not suitable for such a large scale project. I became aware of it quite some time ago but fortunately do not live in your road, so it does not personally cause me a problem.

Would also like to say, you are totally damaging the credentials of your site with your somewhat scathing comments in respect of people who do not share your hobby (quote, for example, "the narrow mindedness..."). People are entitled to their opinions and you must respect this right, whether you agree with their views or not. For you to dismiss them in the manner you have is quite simply rude, disrespectful and uneccessary. I can totally understand people living in a built up area such as yours do not appreciate living in the middle of a kennel. And are you REALLY ignorant to the sounds of 16 dog bowls scraping on concrete??? Thank God you are not my neighbours!!!

Finally there are several spelling and gramatical errors throughout the site you may wish to address in order to promote a professional image for the site.

Quote. large number of dogs are being kept in such a confined area. It may seem a large number of dogs to many people , but to me... its a small number of dogs, well balanced and catered for, since I have worked at a kennel that holds 100+.
The space available to the dogs is good (quoted by our vet); and as I have quoted before; dogs housing in the garden is purely for their safe haven, feeding and rest, nothing more. Dogs are exercised at our local forest and there needs are met in everyway possible. They are working dogs and during the winter, they run in excess of 1000miles as previously mention in literature!

Yes; people are entitled to there opinions (even though most are not factual)... I never said or mentioned otherwise! But I stand by my original comments; as for some, the narrow mindedness quote stands! It's ok to here noise from screaming children, summer evening parties, summer barbecues, other dogs barking during the day while the owners are out.... or the noise of a lawn mower on a Sunday morning perhaps! But the noise from a few dogs bowls being placed down on the deck while feeding over a few minutes is prohibited???? I rest my case! Although I do intend to glue rubber to the bottom of each feeding bowl as a sound dampening device.

Off course.... maybe give us a visit and see for your self the overall operations! Spend a day with us!!!

And please.... the word kennel can be so misinterpreted! We use the word kennel runs or kennelling in the sense of a safe haven for our dogs, just like one might keep there pet in during the day in ones back garden! It is not a business in the sense of the word.

FYI: EHO monitored our situation last year and found NO noise nuisance or environment issues. Any undue noise would include children playing, seagulls passing vehicles etc. We are always more than happy to be monitored again by the EHO.
